Two bills passed in Haryana Vidhan Sabha

Chandigarh, March 20 – Two bills were passed in the budget session of the Haryana Vidhan Sabha session here today. These bills include, the Pandit Lakhmi Chand State University of Performing and Visual Arts, Rohtak (Amendment) Bill, 2023 and the Haryana Development and Regulation of Urban Areas (Amendment) Bill, 2023.

In addition to this, the Haryana School Education (Amendment) Bill, 2023 was also introduced in the House. This Bill will be discussed in detail in the House.

The Pandit Lakhmi Chand State University of Performing and Visual Arts, Rohtak (Amendment) Bill, 2023

The Pandit Lakhmi Chand State University of Performing and Visual Arts, Rohtak (Amendment) Bill, 2023 was passed to amend the Pandit Lakhmi Chand State University of Performing and Visual Arts, Rohtak Act, 2014.

State University of Performing and Visual Arts , Rohtak was established by an Act of Legislature of State of Haryana ( Act 24 of 2014 ) by upgrading the integrated campus of Government Technical Institution (s) Societies , Rohtak , comprising of four institutes namely State institute of Fine Arts , State Institute of Design , State Institute of Film and Television and State Institute of Urban Planning and Architecture into a leading University to facilitate and promote studies and research in emerging areas of Higher Education with focus on new frontiers of design, Fine Arts, Film & Television, Urban Planning and Architecture and also to achieve excellence in these and connected fields.

These four institutions were started in the year 2011 with an annual intake of 240 students and were affiliated with the Maharishi Dayanand University, Rohtak. The State Government has provided 35.97 Acres of land for the construction of Teaching and Admin block, hostels, Guest house, Staff residencies etc. and was providing 100 % Grant - in - Aid to these institutions. This University is emerging as one of the leading Universities of the Country in the Performing & Visual Arts and in the field of Mass Media.

Thereafter, the Government changed the name of the University to " Pandit Lakhmi Chand State University of Performing and Visual Arts, Rohtak " through a State University of Performing and Visual Arts, Rohtak (Amendment), Act, 2018 (Haryana Act No. 10 of 2019) with the name of Indian poet of Haryanvi language, who was honoured posthumously as Surya Kavi by the State Government.

Keeping in view the popularity of Pandit Lakhmi Chand as Dada Lakhmi Chand, the Government has again taken the decision to change the name of the University as " Dada Lakhmi Chand State University of Performing and Visual Arts, Rohtak ".

Therefore, it has been decided that the name of the University be amended from " Pandit Lakhmi Chand State University of Performing and Visual Arts, Rohtak " to " Dada Lakhmi Chand State University of Performing and Visual Arts, Rohtak ".

The Haryana Development and Regulation of Urban Areas (Amendment) Bill, 2023

The Haryana Development and Regulation of Urban Areas (Amendment) Bill, 2023 was passed to amend the Haryana Development and Regulation of Urban Areas Act, 1975.

In order to streamline the operationalisation of online Transferable Development rights (TDR) management system, certain amendments in the Act of 1975 have been considered necessary. The definition of TDR in clause (n2) of section 2 is proposed to be amended to incorporate an enabling provision for transfer / sale of TDR certificate through sale, trade, auction mechanism, and, to rectify the inadvertent restriction imposed in the definition on geographical location of the buyer of TDR certificate.

According to this, the certificate of development rights given to an owner who surrenders such land to vest with the Government without claiming any compensation and such development rights may be sold or traded or auctioned by the owner.

Further, existing sub - section (1) of section 8A of the Act of 1975 is proposed to be substituted to allow engagement of professionals or agency by the Director to enable delivery of online functions of the Department. Enabling provision is also proposed to be inserted to enable online processing of TDR application, its online issuance, holding in dematerialized form, its online sale, trade, auction and its utilization (partly or fully) and performing of all other related functions in online mode.

The Director may perform all functions under this Act through electronic form and internet or may engage any person or agency to perform such functions on his behalf. In section 8-A of the principal Act, after clause (c) of sub-section (2), the following clause shall be inserted.

Sub-section (3) in section 8A of the Act is inserted for fee collected under this sub-section shall be maintained in an Information Technology fund created, managed and operated by the Director for Information Technology related expenses.

Chandigarh, March 20: Chief Minister, Sh. Manohar Lal expressed gratitude to the Union Minister for Railways and Communications, Electronics and Information Technology, Sh. Ashwini Vaishnaw for issuing a postage stamp in the name of Lord Parshuram.

Notably, during the Lord Parshuram Mahakumbh organized in Karnal, Chief Minister, Sh. Manohar Lal had made several announcements; including the announcement of issuing a special commemorative postage stamp in the name of Lord Parshuram.

The Chief Minister had written a letter to Union Minister, Sh. Ashwani Vaishnaw on January 23, 2023, to issue appropriate directions to the Department of Posts to consider issuing a postage stamp in the name of Lord Parshuram and today the Chief Minister's announcement got a concrete form.

Police Post Incharge among four held accepting bribe worth Rs 5.10 lakh

Chandigarh, March 20 - Acting on different complaints of bribery, the Haryana Anti-Corruption Bureau has arrested three officials and a tout, including a Police Post Incharge Sub-Inspector and two Patwaris, for allegedly accepting bribes of Rs 5,10,000.

While giving this information here today, a spokesperson of the Anti-Corruption Bureau said that in the first case, ACB team has arrested two patwaris for allegedly demanding and accepting bribe of Rs 5 lakh for releasing the compensation claim of the complainant’s land, which was acquired by the government.

Shiv Kumar, Patwari, presently posted in Land Acquisition Office, Urban Estate, Hisar has been caught red-handed accepting Rs 5 lakh bribe. The accused was demanding Rs 20 lakh. Another accused Ashok Kumar, Patwari posted in the land acquisition office Panchkula has been arrested after his connivance came to light. The ACB also booked Balraj, Section Officer of HSVP Panchkula in this case.

In another crackdown on corruption, ACB has arrested Sub Inspector, Samerpit posted as police post incharge Baldev Nagar Ambala and Anit Kumar, a tout, on the charges of demanding bribe money of Rs 10,000 from complainant in lieu of helping in anticipatory bail of the complainant in a case registered under Excise Act at Police Station Baldev Nagar, Ambala. Accused Anit Kumar, tout was caught red-handed on the spot with bribe money of Rs 10,000. He was accepting money on behalf of the accused Sub-Inspector.

The Anti-Corruption Bureau team has started further investigation by registering cases against the accused under Prevention of Corruption Act.

Attention is being paid to completely end the problem of water logging in the villages of Badli assembly constituency- JP DALAL

Chandigarh, March 20: Agriculture and Farmers Welfare Minister, Sh. JP Dalal said that attention is being paid to completely end the problem of water logging in the villages of Badli assembly constituency. He said that remedial measures were devised and implemented to drain out accumulated flood water by deploying electric pump sets/diesel pump sets in the existing infrastructure.

The Agriculture and Farmers Welfare Minister was replying to a question during the ongoing budget session of Vidhan Sabha today.

He said that the fields in villages Badli, Deshalpur, Bupania, Shahpur, Gangarwa, Luksar, Surehti, Jagratpur, Khuddan, Chhappar, Munda Khera, Silana, Silani, Subana, Chandol, Dhakla, Ahri, Sondhi, Jaitpur, Neola, Dever Khana, Badhsa, Kasni, Patoda, Lohari, Kulana and Koka of Badli Assembly constituency were waterlogged due to monsoon and unseasonal rain. Sh. JP Dalal said that necessary machinery has been made available by the department to drain out the water and further work is being done in this regard.

House that a grievance redressal drive was conducted by the department to redress the grievances of Guest Teachers- Kanwar Pal

Chandigarh, March 20 - Haryana School Education Minister, Sh. Kanwar Pal informed the house that a grievance redressal drive was conducted by the department to redress the grievances of Guest Teachers wherein 1,699 Guest Teachers participated and out of which 1,347 guest teachers were successfully adjusted on Temporary Deputation basis in the school of their choice.

Sh. Kanwar Pal said this in response to a question raised by an MLA during the Budget-Session of Haryana Vidhan Sabha here today.

He further informed that few guest teachers have been transferred away from their home districts during the General Transfer Drive. He added that the government is making strenuous efforts in order to resolve their issues.

Chandigarh, March 20 - Haryana Deputy Chief Minister, Sh. Dushyant Chautala, in response to a question raised by a member of house during the Vidhan Sabha session, said that the Haryana Development and Regulation of Urban Areas Act, 1975 (Haryana Act No. 17 of 2020 dated September 14, 2020) does not ban the registration of properties located in controlled areas in unauthorized/illegal colonies.

He pointed out that initially, this section was introduced in the law on May 24, 1989, under which it was mandated that NOC is required for sale or gift or lease of a piece of vacant land having area less than one hectare. Thereafter, by the amendment of April 3, 2017, the No Objection Certificate was made mandatory for agricultural land with an area of less than two kanals. Further, an amendment was made on September 14, 2020 by which NOC has been made mandatory for sale or gift or lease of any vacant land having area less than one acre.

Sh. Dushyant Chautala said that there is no provision for conducting any survey in the Haryana Development and Regulation of Urban Areas Act, 1975 before the amendment in Section 7-A of the Act.

The provisions of Section 7A does not describe any kind of land such as ‘gairmumkin’ to be registered. Further, the Government has not stopped registries for any kind of land except where the provisions of the Act are violated.

Chandigarh, March 20 - Haryana Deputy Chief Minister, Sh. Dushyant Chautala, in response to a question raised by a member of house during Vidhan Sabha session, informed that the ration card holders whose cards have been discontinued are being thoroughly investigated. According to the rules, if they are found eligible, their ration card will be issued again and remaining ration will also be provided.

He informed that on the basis of data provided by the Citizen Resource Information Department (CRID), 8,41,817 families have been found ineligible for pink cards. Due to the discontinuation of their ration cards in December, 2022 ineligible families have not been provided ration for the month of January, 2023. It was further informed that that ration has been allocated to 31.59 lakh BPL/AAY families for the month of January, 2023 as compared to 26.94 lakh families for the month of December, 2022.

The Deputy Chief Minister stated that the annual income should be less than Rs. 1.80 lakh for making Priority Household (BPL) ration card. He informed that the eligibility criteria for inclusion of identification of a family as Priority Household (BPL) in the State has been issued by the Rural Development Department and Urban Local Bodies, Haryana vide their notification dated August 3, 2022 and August 31, 2022 respectively and accordingly the beneficiaries are identified by the CRID, Haryana.

He further informed that under the National Food Security Act, 2013, pink cards (AAY) have been issued to 3.02 lakh families as fixed by the Government of India, such families having income less than 1.80 lakh per annum are placed at the bottom of the list of families.

Five government colleges, seven government-aided colleges, and two self-financed colleges are functional in the Kaithal district:MOOL CHAND.

Chandigarh, March 20: Higher Education Minister, Sh. Mool Chand Sharma informed that five government colleges, seven government-aided colleges, and two self-financed colleges are functional in the Kaithal district.

The state government has a policy to open a government college within a radius of 20 kms and all these colleges are within a radius of 5 to 32 kms from the Kaithal assembly constituency, said the Minister while replying to a question asked during the ongoing budget session of the Haryana Vidhan Sabha today.

The Higher Education Minister further informed that the distance of Government College, Jagdishpura is 5 km from the Kaithal Assembly Constituency, the distance of Government Girls College, Guhla Cheeka is 32 km, the distance to Government Girls College, Kalayat is 25 km, the distance of Government College, Ladana Chaku is 24 km and the distance of Government College, Rajound is 29 kms.

Besides this, there are government-aided colleges at Kaul, Fatehpur Pundri, Pundri, Cheeka, and Dhad Dadwana as well, informed Sh. Mool Chand Sharma.

Chandigarh, March 20 - Haryana Urban Local Bodies Minister, Sh. Kamal Gupta said that in the year 2011, a law was passed regarding solid waste management of hotels, marriage palaces and banquet halls. According to the law, Rs. 500 per month is being charged to the hotels, marriage palaces and banquet halls with less than 10 rooms and Rs. 4000 per month is being charged for more than 10 rooms. Rs. 4 per kilolitre for water is being charged. Sewage charges are 25 percent of the water, he added.

This information was given by Dr. Kamal Gupta while replying to a question during the budget session of Vidhan Sabha here today.

The Minister also informed the House that a matter has been referred to the NGT regarding the hotels located on GT Road. The matter has been presented to the Central Pollution Control Board for consideration. Arrangements are being made on the lines of cities to pick up the garbage from hotels where there is no such arrangement. Hotels, marriage palaces and banquet halls will be charged as per rules, he added.

He also informed that by ULB, the tax was not demanded from 2011. It has been demanded for the last three years. The tax imposed would still be rectified and charged from the current year. A letter has been issued in this regard. He informed the house that presently there is no policy under consideration of the Government to provide relief to hotels, marriage palaces and banquet halls in respect of water charges and garbage tax etc.

Dushyant Chautala said that at present no such proposal under consideration regarding construction of a new road from Yamuna Nagar upto N.H. 344 (Panchkula- Kalanaur) highway near camp via PWD rest house. But, if necessary, the concerned MLA should assist in making the land available; the road will be constructed after examining its feasibility.

Various development schemes have been implemented for the welfare of Scheduled Caste in rural areas by the Deployment and Panchayats Department: DEVINDER SINGH BABLI

Chandigarh, March 20- Various development schemes have been implemented for the welfare of Scheduled Caste in rural areas by the Deployment and Panchayats Department. The Development and Panchayats Minister Sh. Devender Singh Babli stated this while apprising details of the works being done for the welfare of Scheduled Caste in the Vidhan Sabha here today. He said that the entire amount released for the development works of Scheduled Caste is being spent on the development works according to the ratio.

Sh. Babli was replying to a question raised by a member in the Vidhan Sabha. He said that execution of development works under various schemes is underway. For this, estimates are obtained and approved by the District Administration. After approval from the Chief Minister, they are issued to the concerned institution.

Giving more information in this regard, he said that the Surcharge on VAT Scheme (Untied) was implemented by the government from the year 2011-2012 to complete the development works in rural areas. Under this scheme, Panchayati Raj Institutions were given funds in the ratio of 75:15:10 for Gram Panchayat, Panchayat Samiti and Zila Parishad for various development works.

Under this scheme, an amount of Rs. 21 crore was released in Scheduled Caste Sub Plan (SCSP) component in the year 2018-19. Under the State Finance Commission (Untied), the Sixth Finance Commission has been constituted for the award period from 2021-22 to 2025-26.

He said that no amount was released during the year 2021-2022 due to non-existence of Panchayati Raj Institutions. Similarly, for the facilities of streets, drainage system, water and electricity in the colony developed under the Mahatma Gandhi Gramin Basti Yojana, the Gram Panchayats given land for these colonies will get Rs. 10,000 per acre as annuity activity. A special task force has been constituted under the chairmanship of the concerned Block Development and Panchayat Officer to analyse the settlements developed under this scheme. Under this scheme, an amount of Rs. 9.52 crore was released in the SCSP component in the year 2022-23.

Sh. Babli said that the SCSP component has been included in the normal component under the Haryana Rural Development Scheme, so this year's amount was released in the normal component only. The Development and Panchayat Minister informed that no amount has been released during the financial year 2022-23 in the SCSP component under the Swachh Bharat Mission (Gramin). He said that an amount of Rs. 10 crore including Rs. 5 crore as SCSP component was released by the Haryana Rural Development Authority in the year 2021-22. He informed that an amount of Rs. 18.23 crore has been released during the year 2022-23 under the National Rural Livelihoods Mission scheme. An amount of Rs. 4 crore has been released during the year 2022-23 under the SCSP component under the Integrated Wastelands Development Project Scheme. He said that detailed information about this has also been made available.

Chandigarh, March 20- Haryana Cooperation Minister, Dr. Banwari Lal said that 741 posts are filled in State Cooperative Banks. The process of filling the remaining posts is underway.

The Cooperation Minister said this in response to a question raised by a member of house in Vidhan Sabha here today.

The Cooperation Minister said that on August 14, 2019, 978 posts to be filled by the Cooperative Department were terminated due to a court case, but about 2060 people have been hired on a temporary basis to run the department. There is no intention to close the department and the staff in the Agriculture and Rural Development Bank is adequate.

He said that 16 out of 242 posts in district Ambala, 51 out of 298 in Bhiwani, 18 out of 227 in Faridabad, 41 out of 202 in Fatehabad, 42 out of 250 in Gurugram, 76 out of 353 in Hisar, 38 out of 176 posts in Jhajjar, 42 out of 245 in Jind, 41 out of 261 in Kaithal, 42 out of 235 in Kurukshetra and 58 out of 332 in Karnal are filled.

The Cooperation Minister informed that there are 32 out of 184 cooperatives in Mahendergarh, 17 out of 114 in Panchkula, 37 out of 193 in Panipat, 45 out of 194 in Rewari, 23 out of 199 in Rohtak, 65 out of 358 in Sirsa, 30 out of 297 in Sonepat, 28 out of 247 posts in Yamuna Nagar are filled. He informed that there are a total of 4608 posts, the process of filling the remaining posts is underway. He informed that 208 posts out of 593 are filled in Haryana State Cooperative Apex Bank Limited, Chandigarh.

CM condemns the unparliamentary behaviour of MLA Abhay Singh Chautala

Chandigarh, March 20- Haryana Chief Minister, Sh. Manohar Lal while strongly condemning the unparliamentary behavior of MLA Abhay Singh Chautala during the ongoing Budget session of ongoing State Vidhan Sabha said that respecting the Chair is the utmost duty of any Member.

He further said that arguing with the Chair should be against the dignity of the House.

The Chief Minister said that in the House, every Member has equal rights to raise their issues before the Speaker. However, misbehaving with the Speaker certainly is not expected from any member and strict cognizance should be taken against such incidents.

The State Government does not interfere in the recruitment process, said Sh. Manohar Lal.

The Chief Minister said that if there is any issue related to ensuring transparency in the recruitment process of HPSC, then the state government can direct HPSC to ensure transparency. But the government cannot interfere in any of the recruitment processes of HPSC, said Sh. Manohar Lal.

He said that for the recruitment of any post, again it is HPSC that decides if to take objective type (OMR based) or subjective type examination. The Commission publishes the detailed syllabus for each post and conducts the exam accordingly, said the Chief Minister.
